PLEASE READ THESE TERMS AND CONDITIONS OF SALE ("SALE AGREEMENT") VERY CAREFULLY.

THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS (UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH POPEYESTORONOTO.COM IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN).

Important Information About This Legal Contract This Sale Agreement is a legal contract between the Customer and PopeyesToronto.com. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. (References to "you" or "your" shall relate to the Customer; references to "PopeyesToronto.com" shall relate to PopeyesToronto.com and its affiliates.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question.

This Sale Agreement constitutes the entire agreement between the Customer and PopeyesToronto.com relating to the purchase or sale of goods or services on the Site. PopeyesToronto.com reserves the right to cancel, amend and/or refund orders placed without prior consultation.

GOVERNING LAW

THIS AGREEMENT AND ANY SALES HERE UNDER SHALL BE GOVERNED BY THE LAWS OF THE ONTARIO, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR PROVINCIAL COURTS LOCATED IN CANADA FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.

TITLE; RISK OF LOSS

Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to the purchaser. Loss or damage that occurs during shipping by a carrier selected by Customer is Customer's responsibility. Title to software will remain with the applicable licensor(s).

EXPORT SALES

If goods herein being purchased are being purchased for purposes of export, the Customer must obtain from the federal government certain export documentation before shipping to a foreign country. In addition, manufacturers' warranties for exported goods may vary or even be null and void for goods exported outside Canada. The Customer should inquire further regarding any questions. Any and all liability is only for the products purchased.

GENERAL LEGAL DISCLAIMER

POPEYESTORONTO.COM HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER BY POPEYESTORONTO IN NO WAY AFFECTS THE TERMS OF THE MANUFACTURER'S WARRANTY, IF ANY.

ORDERS; PAYMENT TERMS; TAXES

Orders are not binding upon PopeyesToronto.com until accepted by PopeyesToronto.com. Prices listed on the site are indicated as an invitation to treat, without prejudice, and are not contractually binding. Terms of payment are within PopeyesToronto.com's sole discretion. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. PopeyesToronto.com may invoice parts of an order separately. The Customer is responsible for sales and all other taxes associated with the order. FREIGHT POLICY

Shipping and handling charges on all orders vary; contact orders@PopeyesToronto.com for our most current and competitive rates, options and shipping specials. For the Customer's protection, we ship only to the verified billing address of the Customer's credit card. In some circumstances, international shipping may be available. Call for details.

CANCELLATION POLICY

Cancellation fees apply to cancelled orders that are already in the processing phase. The lesser of $5 or 10% of the order value will constitute the fee and is not refundable in the event of a cancellation.

An order cannot be cancelled after it has been dispatched from our premises.

An order cannot be cancelled if items were specifically requisitioned, by us, from our suppliers to fulfill the order.

RETURN POLICY

The following refund policy applies to all products except those stating their own refund policy with the product description

We offer 100% hassle-free return policy to our valued customers within 14 days of the invoice date provided that the product is unopened.

Please contact us by Email before shipping your product. Please mention the following when emailing us: Order Number and the reason for return, its that simple.

In order to get full refund the product MUST be unopened.

If merchandise arrives damaged: it is best to REFUSE it back to the carrier attempting delivery. If you accept the package make sure it is noted on the carrier's delivery record in order for PopeyesToronto.com to file a damage claim. Save the merchandise AND the original box and packing it arrived in, notify PopeyesToronto.com immediately to arrange for a carrier inspection and a pick up of damaged merchandise. If you do not notify PopeyesToronto.com of damaged goods within the first 14 days of arrival, our regular return policy will override any claim of damage, and will fall under all current manufacturer restrictions. Call 416-924-5050 to arrange for carrier inspection and a pick up of damaged merchandise.

DEFECTIVE products can be returned directly to PopeyesToronto.com within 14 days from the invoice date, at PopeyesToronto.com discretion for: credit, replacement or exchange.

Manufacturer restrictions do apply and are outlined in our detailed policy. Any item that is missing the UPC can ONLY be replaced with the same item. After 14 days, all manufacturers' warranties apply.

The only exceptions to the return policy are:

  • Essential Oils
  • Bars
  • Grocery 
  • Clearance Items
  • Any items marked as final sale on the product page 
  • Workout Accessories

Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Popeye's Supplements Toronto’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Popeye's Supplements Toronto through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Popeye's Supplements Toronto. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Popeye's Supplements Toronto mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.
